Question about legendary rule

704.5k If a player controls two or more legendary permanents with the same name, that player chooses one of them, and the rest are put into their owners' graveyards. This is called the "legend rule".

Could I have Anafenza, the foremost out at the same time as Anafenza, kin-tree spirit since they're different card names, or are they treated as having the same name of Anafenza?

You can have both an Anafenza, Kin-Tree Spirit and a Anafenza, the Foremost out at the same time. They do not have the same card name, so they are two separate legendary creatures.

Anafenza, the Foremost and Anafenza, Kin-Tree Spirit are two different named cards.

A quick aside as well. Note that the same rule doesn't apply for planeswalkers. Planeswalkers are subject to the planeswalker uniqueness rule where you can only have one of a single subtype on the field. For instance, you can't have both Jace, the Mind Sculptor and Jace, Memory Adept in play since they are both share the 'Jace' subtype despite being different card names.
