Not your fault, I see this a few times a month. If multiple people within a prolonged time frame are posting this than it must be something going wrong somewhere. Where and when did you see it marked as legal?

Ultra Low Budget Mill. the deck is listed as modern, and legal, but it contains brainstorm. First seen on january 13, but still listed as legal on the 26th

I can confirm that the legalities of Brainstorm aren't checked when put into a modern deck.
