Getting around the "God X can't attack unless Y" with Identity Thief

Let's say your field has Rhonas the Indomitable and Identity Thief, and no creatures large enough to allow Rhonas to attack. Could you attack with Identity Thief, exiling the God, and still attack as a copy of snek-god?

When Rhonas comes back from exile, is Identity Thief still a copy of Rhonas, forcing one of them to be put in the graveyard as a state based action?

you choose to exile Rhonas
identity theif becomes a copy of Rhonas which is still attacking
at the beginging of the end step Rhonas comes back into play
and the legend rule kicks in

Yes, as Identity Thief is already attacking when it becomes a copy of Rhonas the Indomitable it will still be attacking. It will also still be a copy when the original returns, so you will have to send one the the graveyard as a state-based action.
