It is not legal as a commander, because the flip is a change of characteristics from what the card actually is, which is a Creature - Rat Rogue and not a legendary creature at all.
If they had a way to make the Nighteyes half not even visible until the condition was met, they'd probably have done that. Everywhere but on the battlefield after the flip condition is met, that card is just Nezumi Graverobber, 2/1 Rat Rogue creature.
