Hymn to Tourach Legal?

Ok so i am building a black red pauper deck and i was going to include hymn to tourach but then my friend thought that it was banned because in MTGO it was printed only in uncommon rarity, and because pauper was started on MTGO he thought that it would go against the rules. So anyway is Hymn to Tourach legal in pauper?
Wizards, in the pauper deck construction rules, gives an example using Hymn to Tourach and states that since the card was printed as a common in Fallen Empires, it was never released as such in MTGO. It states that Hymn is not legal in pauper.

Well, according to WotC, you can only play Pauper through Magic Online. So don't bother playing Pauper on your tabletop

As far as Wizards is concerned, Pauper is an online format following these legality rules:

Hymn to Tourach is therefore banned if you follow a strict translation of the online rules to paper.
However, your playgroup is free to make adjustments.
