Rights to Images for Playmats

I have no idea where this should go, so I'm going to throw it in general.
I want to use an image that I use as a wallpaper that I got from the Gathering Magic free wallpaper on their site. Do I have to ask their permission to make a playmat out of it or, since they let us use it for free anyway, do I just atribute the art to them and use it without asking.
Secondly, I also want to Kev Walker's art for his Judge Promo Balance, for a playmat. There was not one made yet licensed by Wizards. Who owns the art? If I ask the artist if I can use his art for private use, does it have to go through Wizards first before I can use it with the artists permission?
General insight would be greatly appreciated.
InkedPlaymats doesn't really do mats out of official mtg stuff. They're avoiding legal problems, I guess. Wizards owns the artwork.

I honestly don't know.
You could try contacting the artist and see what they say, or try to contact Wizards. Be sure to mention that you're using it strictly for personal use.

As far as I know, Wizards owns the artwork, although there are special rights granted to the artists. You would need to contact Wizards.
I'm not very knowledgeable about copyright and IP laws. It may be that fair use covers you because you're doing it strictly for private use rather than commercial and because of the nature of the object you're producing. However, you should check with Wizards to be sure.

I prematurely apologize for tagging people but I posted this during the forum blackout and missed the front page time. Since I missed that window, and you guys posted on my playmat post, I hope you all have some insight into this issue.
