Phenax, God of Deception Devotion?

This may be a stupid question, but I just want to clarify this as it is a bit confusing to me.

Okay, so Phenax, God of Deception is on the battlefield. My devotion to blue and black is less than 7. Does this make him just a Legendary Enchantment? If so does that mean my opponent can't use a spell (to destroy target creature) such as Ruinous Path on him?

He would be a Legendary Enchantment, so he would not be a legal target for Ruinous Path. I don't know why they would try to destroy him, because he has Indestructible however.
