You could not use Budoka Gardener
as a commander, as he is not legendary.
From the comprehensive rules:
709.2. In every zone other than the battlefield, and also on the battlefield before the permanent flips, a flip card has only the normal characteristics of the card. Once a permanent is flipped, its normal name, text box, type line, power, and toughness dont apply and the alternative versions of those characteristics apply instead.
If you're really wanting to use him, ask your play group, they might be ok with it.
If you do use him, I (and others) would advise having a legendary creature that is similar in your deck to use as a backup if you play a random person who is not cool with your commander. Something like Azusa, Lost but Seeking
