I want to build a deck around Bushi Tenderfoot Flip, but don't know if I can use it as my commander

You can not run Bushi Tenderfoot Flip as your commander.
Bushi is not a legendary creature. While it is capable of becoming legendary, it is not legendary. So, it can't be your commander.
That said, most playgroups are ok with these sorts of house rules. I highly recommend that you ask the people that you play with to see if they are ok with you running Bushi as your commander. If you don't have a consistent playgroup, I would have a backup creature that can be your commander just in case.
